In June 2014 the House Oversight and Government Reform Committee said Richard Pilger, then Director of the Election Crimes Branch, had given a transcribed interview. The committee said that interview showed the Justice Department met with Lois Lerner in October 2010 — “two and a half years earlier than previously known” — to discuss potential criminal enforcement of nonprofit political speech after Citizens United.
The same release said Pilger testified that Public Integrity Chief Jack Smith asked him to set the meeting, and that Pilger was interested in the “practicalities” of criminal enforcement, including whether IRS could review 501(c)(4) donor lists. Issa and Jordan asked the Department to make Smith available for a transcribed interview. Asking for an interview is not a finding that Smith or Pilger committed a crime.
